Memberships (Academy & The Studio)

While we may offer Content from time to time for free, we charge a fee to access the Services that require a membership or subscription. The Services may include different offerings including Online Videos and resources in the Art2Life Academy & The Studio. You can find the specific details regarding your membership subscription at any time by logging in to your membership account. You agree that your membership is for personal use only.

Because the Service is offered in multiple time zones, for consistency, a “day” for purposes of these Terms begins at 12:00 a.m. Pacific Time and ends at 11:59 p.m. Pacific Time of that same calendar day.

Membership Terms. When you sign up for a membership (subscription) through Art2Life, you agree to the terms and conditions outlined here.

Academy Membership

Academy Member(s) have provided certain personal and financial information and have purchased a subscription to the Academy which grants them access to the library of Academy content, image adjustments, live calls, masterclasses, interviews with artists, access to the private Academy Facebook community and access to bonus content. Registering as an Academy Member includes access for (1) person. Upon registration, you will receive one username, password and member profile for use. If you would like to access the Academy Membership along with another person or collaborator, you each need to individually become an Academy Member.

Academy Memberships purchased from Art2Life have a 30-day money back guarantee, no refunds will be offered after 30 days. Contact Customer Care by submitting a request via email at ac*****@ar******.com with your original order number, full name, description of product and reason for return. Once processed you’ll receive confirmation of the refund.

The Studio Membership

The Studio Member(s) have provided certain personal and financial information and have purchased a subscription to The Studio which grants them access to the library of The Studio content, live studio art sessions, access to the private Studio Circle community and access to bonus content. Registering as a member of The Studio includes access for (1) person. Upon registration, you will receive one username, password and member profile for use. If you would like to access The Studio Membership along with another person or collaborator, you each need to individually become a member of The Studio.

The Studio Memberships purchased from Art2Life have a 14-day money back guarantee, no refunds will be offered after 314 days. Contact Customer Care by submitting a request via email at st****@ar******.com with your original order number, full name, description of product and reason for return. Once processed you’ll receive confirmation of the refund.

Additional Terms Applicable to Academy & The Studio Members.  

  1. THE FACEBOOK/CIRCLE COMMUNITY GROUPS:
  1. You will be provided with the details on how to access the “Facebook Communities” or “Circle Communities” upon registration. The Facebook Community is strictly for paid Academy Members in good standing. The Circle Community is strictly for paid The Studio Members in good standing. Team Art2Life are the moderators of the group and reserve the right to grant or remove access for any member at any time.
  1. Please note that the Facebook Community is a complimentary bonus and not part of the paid membership. We do not own Facebook and if they change their terms, that may limit or remove our ability to keep the Facebook Community open and running. Similarly, in the event that members behave inappropriately or in a manner that is contrary to Facebook’s or Circle’s policies, the Facebook or Circle Community may be eliminated or terminated by either us or Facebook/Circle. In the event the Facebook or Circle Community is terminated, we will have no liability or responsibility to you and you will not be entitled to any refunds.
  2. The primary intention of the Facebook & Circle Communities is to serve as classrooms for the courses & memberships to be taught. It’s not a place to find customers, or recruit people to other programs or groups.
  3. Anything posted in or uploaded to the Facebook or Circe Community, whether comments or images, becomes the property of the group or community, and in the event the Facebook or Circle Community is terminated or your access to the Facebook or Circle Community is terminated or suspended, your posts may disappear and cannot be retrieved.
  4. By joining as an Academy member or The Studio member you agree to abide by these Terms and the requirements as outlined in this section. If you join the Facebook or Circle Community, you also agree to abide by any policies or terms set by Facebook and Circle. Failure to comply with any of these Terms may result in the suspension or termination of your membership or your removal from any or all of the Membership Sites (as defined below), without notice to you and without refund of any fees paid. We reserve the right, in our sole and absolute discretion, to deny you access to the Membership Sites, or any portion of the Membership Sites, without notice, and to remove any content that does not adhere to these Community Guidelines.
  5. The “Membership Sites” consists collectively of the Academy Portal, the Academy Facebook Community and The Studio Circle Community. The Membership Sites are places for you to discuss and share only about the teachings, art, and content created by Art2Life. 
  6. The Membership Sites & Communities are pitch-free, spam-free and solicitation-free zones. You are encouraged to share your experience and participate. However, you are not permitted to offer, sell, promote or advertise your or other third party services, programs or products and you may not invite Academy members, The Studio members to join other social networks, groups, or programs. Sharing affiliate links or conducting any type of solicitation within these Sites is strictly prohibited.
  7. Any offensive posts, as determined by Art2Life in its sole and absolute discretion, will be removed. Without limiting the generality of the foregoing, Art2Life reserves the right, at any time, to remove any and all posts, images or videos it, in its sole discretion.

The Art2Life Academy & The Studio communities are your place to create, connect, inspire and share with one another. We want this community to also be safe and respectful for everyone involved.

Here are the guidelines to help us build and maintain our community.

CARE, COMPASSION AND RESPECT

Please take responsibility for the energy you bring into our community. Please be thoughtful, especially when judging others’ artwork. We need honest feedback obviously, but offer it along with a positive idea or tip that can help lead to a solution. Critique others in a way that you would like to be. Treat everyone with care, compassion and respect. Healthy debate about ideas is natural, and virtual communication can be tricky sometimes, but personal attacks are not acceptable. Ever. If you’re feeling upset about something another member has said, or shared, take some time before responding. If unclear about how to respond, reach out to one of our Support Team members.

KEEP IT POSITIVE

This is a positive environment for creative support. Please don’t gossip or trash talk about any of our Academy & The Studio members or anyone else for that matter. We don’t need to put others down even when we feel frustrated. If you have a challenging issue, either with the program, a support team member, or any community member, resolve it directly via email or even a call. Keep it private and outside of our community. Again, if you are unclear about how to respond, reach out to one of our Support Team members.

GIVE AND YOU WILL RECEIVE

Ask for what you need. If you want feedback, ask for it. If you’re stuck and need some ideas…ask. If you’re not getting what you need when you post, check your ask. Was it clear? If not, ask again. Always assume positive intent and reach out.

Give help to your fellow Academy & Studio members. Each time you ask for feedback, provide feedback to two members. Share what you’re working on. Share when you have figured something out, especially when others are still struggling with the same issue. Share what you’ve found. Share what challenges you. Share your wins. Cheer for others. Keep the focus on sharing, support and encouragement. Give more than you ask…and we’ll all benefit.

BE ORIGINAL

Please do not copy, steal or share any community member’s intellectual property. If you have a question about using another Academy or Studio member’s content, check with them first. Do not assume permission. All content on the Academy and The Studio site, including any videos and downloads are for your personal use only. They cannot be shared with anyone outside of the program, nor can they be used for any professional use. All content provided by Art2Life is copyrighted and unauthorized use is strictly forbidden.

MEMBER SELF PROMOTION POLICY

The purpose of our Academy Facebook Group and The Studio Circle Group is for our community of artists to share, support and inspire each other in relationship to creating and improving their art.  In an effort to keep the Academy Facebook Group and The Studio Circle Group relatively clear of advertisements and offerings, please do not solicit or promote these offerings to Academy or Studio members except during our designated time and place.  Here is a guide of what, when and where to post your offerings:

  • All posts that are self-promotion in nature and are not related to art that you are creating, should be posted under the provided post in the Academy Facebook Group on the 1st Thursday of every month. Keeping the posts in one place helps keep the Facebook feed more organized, and provides an opportunity for more people to see your posts. These posts include blogs, newsletters, workshop/course offerings, artist interviews, services relating to art, book releases, and your individual art for sale.
  • NOTE: The one exception is that we do allow exhibition or art show announcements to be posted at any time.
  • Posting under the MEMBER SELF PROMOTION Post Tag is only available on the 1st Thursday of each month.
  • Any business offerings posted elsewhere in the Facebook group, will be automatically deleted.
  • Fundraisers of any kind are not allowed at any time unless previously approved by Art2Life. 

We understand posting in the wrong place is usually inadvertent. However, if this guideline is repeatedly ignored, it could result in your removal from the Academy or The Studio. If you are uncertain whether what you are sharing or asking is appropriate, reach out to Support at ac*****@ar******.com or st****@ar******.com

Lastly, please do not automatically add Academy or Studio members to your newsletter and/or email list. No spamming and/or violating another member’s privacy is allowed.  

Please note that offerings posted in the Facebook Group’s 1st Thursday Posts are offered by individual artists and are not endorsed by Art2Life or Nicholas WIlton.

Please note that it is at the discretion of the Art2Life Team to remove a post or to turn off commenting if a post goes against our Community Guidelines and/or is not benefiting the Community.

DUE DILIGENCE

​If you do decide to hire or create any contractual relationship with any of our Academy or Studio members, you do so at your own risk and outside of the framework of this program. We recommend you have clear written contracts and service agreements in place. The Art2Life Academy, The Studio and/or Nicholas Wilton are not responsible for any loss of revenue, damages, breach of contract, or any other unfavorable circumstance as a result of such relationship.

WHAT ABOUT ME

​If, for some reason, things are not going the way you had hoped in the program, either with the community or the program itself, please don’t hesitate to reach out to the Support Team. We want you to have the best experience possible, but things do come up despite all our best efforts.Please don’t take things personally. Often the intent of others is different than what you might be feeling or experiencing. If you feel no one is commenting on your post, remember that this is a large group and things move fast…it’s a lot to keep up with. So repost. The fastest way to build connections and friendships with other community members is to be helpful. If you are, then you will be more than adequately helped in return. Try treating each other like good friends, sooner rather than later.

ACADEMY MEMBERSHIP

Your membership purchase includes your unique login credentials.  Each participant must purchase a membership to have access to the Academy website and therefore we ask that you do not share your access with others – including zoom links and passwords.

Please notify us immediately should you have any changes to your payment method.

If a member falls behind on payments without notifying the Art2Life team, past due balances will need to be paid before the member can cancel or reinstate their Academy membership, or partake in other Art2Life programs.

Should we have a problem with your payment, a member from the Art2Life team will notify you via the email address linked to your account, or the phone number you’ve provided. You may also receive an email from SamCart, our credit processing service, with instructions to update your card. If we do not hear back from you and/or your payment information has not been updated within a week of the first email notification, you will be removed from the Academy and denied access to Art2Life programs until the outstanding balance is paid.

THE STUDIO MEMBERSHIP

Your membership purchase also includes your unique login credentials to The Studio.  Each participant must purchase a membership to have access to The Studio website and therefore we ask that you do not share your access with others – including zoom links and passwords.

VIRTUAL OPEN STUDIO GUIDELINES

Your membership includes access to The Studio’s Virtual 24/7 Open Studio via Zoom.

By participating in this offering, you are agreeing to the following:

  1. The Zoom Virtual Open Studio room is being recorded for security and quality assurance purposes.
  2. By joining, you consent to being recorded while in the Virtual Open Studio Zoom room.
  3. Inappropriate behavior, harassment, or disruptive conduct will not be tolerated and may result in your removal from Art2Life.
  4. Please avoid sharing sensitive or confidential information.

ART2LIFE SUBGROUPS

If you decide to form a subgroup and want to create a Facebook, Zoom, or any other kind of group, please follow these guidelines:

  • Include this disclaimer in your group description: “This group is not endorsed by any Art2Life Programs, team members, or Nicholas Wilton.”
  • Do not use Art2Life, Nicholas Wilton, or any names of Art2Life programs or memberships (CVP, Academy, The Studio, etc.) in the title of your group.
  • Do not use any logos or images from Art2Life or its programs.
  • Do not promote your subgroup within any Art2Life Programs, Facebook groups, Social Media Channels, Community Groups or Art2Life websites.

WHAT HAPPENS IF YOU DON’T FOLLOW THESE GUIDELINES

We really believe that everyone wants the best for each other and this program. It is in the greater interest of the larger community that we are all creating, that these guidelines are put in place. It is critical that they are respected and followed. If, on the off chance, anyone ignores or repeatedly violates the guidelines, they will be removed from the program. PARTICIPATION.  Participant understands that Participant’s results are not guaranteed by A2L and that, further, Participant’s results are reliant on Participant’s own efforts and implementation of the suggestions and teachings of A2L.    

A2L reserves the right to release any Participant from the program. 

 

WORK PRODUCT OWNERSHIP. Any copyrightable works, ideas, discoveries, inventions, patents, products, or other information (collectively the “Work Product”) shared by A2L in connection with the Services are the exclusive property of A2L. Artwork created by the Participant during this Agreement shall be the exclusive property of the Participant. 

 

MEDIA RELEASE. Participant grants to A2L, and his or her legal representatives and assigns, the right to use and publish video, photographs, digital images, and copies of artwork provided and taken by Participant for its use in its marketing and sales materials.  Participant permits alterations for the purposes of file size and image adjustment for teaching purposes. Participant hereby releases A2L and its legal representatives and assigns from all claims and liability relating to said photographs. Participant acknowledges that he or she is over the age of 18.

INTELLECTUAL PROPERTY PROVISIONS. Participant agrees that he or she shall not use, commercialize or disclose the Proprietary Information taught in the Academy, including the downloadable materials to any other person or entity.  Participant shall not develop or acquire new programs incorporating the Proprietary Information taught to it as part of this Program.  The parties acknowledge and agree that any and all new variations of this Program shall be considered included within the definition of “Proprietary Information” for purposes of this entire Agreement. Notwithstanding the foregoing, any new programs or systems that are not derivations of, variations upon, or confusingly similar to, the Proprietary Information that are developed by Participant shall be the sole property of Participant.  

ASSIGNMENT.  Except as otherwise expressly stated, neither this Agreement nor any of the rights, interests or obligations hereunder may be assigned, transferred, conveyed or delegated by either A2L or the Participant in any manner without the prior written consent of the other party.  

INDEMNIFICATION. The Participant agrees to indemnify and hold harmless the A2L from claims and suits including court costs, attorney’s fees, arising out of or resulting from any use, reuse, or modification of the A2L’s Services and proprietary methods.  

CHOICE OF LAW, FORUM. This Agreement shall be governed by the laws of the State of California, without reference to or use of any conflicts of laws provisions. The parties hereto agree that with respect to any disputes, actions, suits or proceedings arising in connection with this Agreement, venue will be in the State of California in the action is brought by participant against A2L. In the event an action is brought by A2L against the Participant, suit may be filed in the State of California. A2L retains and reserves all rights to enforce this agreement internationally, without borders.  

SURVIVAL. All provisions shall survive expiration or termination of this Agreement for any reason and shall remain in full force and effect in accordance with their respective terms, without modification, limitation or impairment of any kind.  

STATUS OF THE PARTIES. This Agreement does not create, is not intended to create, and shall not be interpreted or construed as creating a partnership, joint venture, agency or employment between Participant and A2L.   

NOTICES. All notices and other communications under this Agreement must be in writing and will be deemed given (a) when delivered personally, (b) on the fifth day after being mailed by certified mail, return receipt requested, or (c) the next day after delivery to a recognized overnight courier.  

ATTORNEYS’ FEES AND COSTS. Each party agrees to bear their own attorneys’ fees or other costs in the event such costs are incurred to secure performance of any obligations, or to establish damages for the breach or to obtain any other appropriate relief. The parties further agree to mediate this matter prior to litigation utilizing a certified mediator.  

SEVERABILITY. If any part of this contract is declared invalid or unenforceable, the remainder of this contract shall not be affected and shall remain in full force and effect.  

BINDING EFFECT. This Agreement will be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.  

These Terms and Conditions contain the entire agreement and understanding of the parties hereto. Any representation, condition or promise not contained expressly herein shall not be binding upon either party. Any amendment or modification of this Agreement must be in writing and signed by an authorized representative of each party.   

Billing for All Art2Life Memberships

By providing a credit card or other payment method accepted by art2life.com (“Payment Method”) for your membership, you are expressly agreeing that we are authorized to charge you a periodic membership fee on a recurring basis corresponding to the term of your subscription, any other fees for additional services you may purchase, and any applicable taxes in connection with your use of your membership to the Payment Method. If you want to use a different Payment Method than the one you signed up to use during registration, or if there is a change in your credit card validity or expiration date, please email our Customer Care at in**@ar******.com and they will assist you with updating this information. If your Payment Method expires and you do not edit your Payment Method information or cancel your account, you authorize us to continue billing, and you will remain responsible for any uncollected amounts.  Please note: we offer a 30-day Money Back Guarantee on our Academy memberships and a 14-day Money Back Guarantee on our Studio Membership the first time you sign up ONLY, after that all purchases are non-refundable.

As used in these Terms, “billing” shall indicate either a charge or debit, as applicable, against your Payment Method. The membership fee will be billed at the beginning of your membership period and on each periodic renewal date thereafter unless and until you cancel your membership or the account or service is otherwise suspended or discontinued pursuant to these Terms. Your membership end date varies based on the time of purchase. Membership terms can be monthly or annually depending on the membership purchased. To find out the commencement date for your next renewal period, email our Customer Care at in**@ar******.com. If you are a monthly member, you will be billed every month on the date of purchase (for example, if you purchased on November 4, you will be billed on December 4, then January 4, etc.)

We automatically bill your Payment Method based on the commencement date of your membership purchase. The interval of time between each payment due date shall correspond to the term of the membership you purchased and be referred to herein as a “Billing Period.”  You acknowledge that the timing of when you are billed and the amount billed each Billing Period may vary, including for example due to promotional offers, gift card redemptions, credits applied, changes in your membership, changes in your Payment Method, and changes in applicable taxes, and you authorize us to charge your Payment Method for the corresponding amounts.

If we offer you a promotion (e.g., a promotional price) for your membership, the specific terms of the promotion will be disclosed during your sign-up or in other materials provided to you describing the particular promotion. In the case of promotional pricing, after your promotion ends, we will begin billing your Payment Method for your subscription at the regular price after your promotion ends unless you cancel prior to the end of your promotion or unless otherwise disclosed in communications made available to you.

Art2Life LLC reserves the right to change the terms of your membership, including price, from time to time, effective as of the beginning of your next Billing Period following the date of the change. If Art2Life LLC changes the membership fee or other charges for your members, we will give you advance notice of these changes by notifying the email address provided during purchase.

Ongoing Membership and Cancellation. Your membership will continue in effect on a recurring basis corresponding to the term of your membership unless and until you cancel your membership or the account or membership service is otherwise suspended or discontinued pursuant to these Terms. You must cancel your membership before your next renewal date in order to avoid the next billing. We will bill the periodic membership fee plus any applicable taxes to the Payment Method you provide to us during registration (or to a different Payment Method if you change your account information). If you cancel your membership, cancellation will be effective at the end of the current Billing Period – this means that you will have continued access to your membership benefits for the remainder of that period, but you will not receive a refund. If you purchased your subscription through an Art2Life website, you can cancel your membership by contacting our Customer Care at in**@ar******.com

Free Trials. Art2Life may offer free trials to a particular subscription, subject to a specific time frame explained during your sign-up. Art2Life LLC reserves the right to determine eligibility for free trials; specifically, customers who have previously redeemed a free trial may not redeem another free trial in the future (certain exceptions to this rule may be made on a case-by-case basis depending on the promotion). Certain limitations may also exist with respect to combining free trials with any other offers.

It is very important to understand that you will be automatically charged for the subscription after your free trial has ended. If you wish to avoid charges to your Payment Method, you must cancel your subscription prior to midnight local time on the day before the end of your free trial period. You may cancel your subscription at any time as described in the “Ongoing Membership and Cancellation” section of these Terms.

Unpaid Amounts. It is important that each member honor the payment obligations to which the member agreed. Accordingly, we reserve the right to retry billing your Payment Method after failed attempts (e.g., if your Payment Method is rejected). We also reserve the right to pursue any amounts you fail to pay in connection with your membership. You will remain liable for all such amounts and all costs incurred in connection with the collection of these amounts, including, without limitation, bank overdraft fees, collection agency fees, reasonable attorneys’ fees, and arbitration or court costs.

Accounts and Registration. You are responsible for all use of your account, including use of your account by other members of your household. By allowing others to access your account, you agree to be responsible for ensuring that they comply with these Terms and you agree to be responsible for their activity using the Services.

All registration information you submit must be accurate and updated. Please keep your password confidential. You will not have to reveal it to any Art2Life LLC representative. Because you are responsible for all use of your account, including unauthorized use by any third party, please be very careful to guard the security of your password. Please notify us by email at in**@ar******.com if you suspect any unauthorized use of your account. Please also make sure to notify us if your registration information changes, in case we need to contact you.

Please see the section “Ongoing Membership and Cancellation” above for instructions on how to cancel your membership.

We reserve the right to immediately terminate or restrict your account or your use of the Services or access to Content at any time, without notice or liability, if Art2Life LLC determines in its sole discretion that you have breached these Terms, violated any law, rule, or regulation, engaged in other inappropriate conduct, or for any other business reason. We also reserve the right to terminate your account or your use of the Services or access to Content if such use places an undue burden on our networks or servers.

Modification. Art2Life.com reserves the right to make changes to the Art2Life.com Web site, posted policies and these Terms of Use at any time without notice. These Terms of Use were last revised on July 19, 2024.
